TERMS OF SERVICE & MEDIA RELEASE

Effective Date: April 17, 2026


1. Capture, Production & "Signature" Standards

  • Authorization: I grant permission to photograph and record the Participant. I authorize Sporty-Clips, LLC to use the Participant’s Likeness, Name, Organization, and Identifying Details (e.g., Jersey #) for media production, custom graphics, and gallery sharing with authorized participants, team/organizational families, and staff.
  • Copyright: Sporty-Clips, LLC retains all copyrights to all images and recordings.
  • Artistic Integrity: To maintain our boutique brand, only final, edited media is delivered. Unedited drafts and RAW files are strictly unavailable.
  • Compensation: I release Sporty-Clips, LLC from any claims for royalties or compensation beyond the provided services.


2. The "Vault" Archive & Data Privacy

  • Event-Specific Access: This authorization applies specifically to the event or session for which this form was submitted.
  • Secure Preservation: Media is archived in the "Vault" (utilizing zero-knowledge, Swiss-grade encryption and off-site redundancy) for a minimum of one (1) year.
  • The Active Window: Galleries remain open for standard orders for 60 days from the Notification Date.
  • Archival Retrieval: Once the Active Window has closed, galleries move to deep storage. Requests to re-open a gallery require manual retrieval and are subject to a standard Archival Retrieval Fee.

Liability: While the Vault utilizes enterprise-grade security, Sporty-Clips, LLC is not liable for third-party hosting breaches or unauthorized access resulting from shared client credentials.


3. Financial Policy: All Sales Final

  • No Refunds: Due to the digital nature of Sporty-Clips media and custom prints, all sales are final.
  • Licensing: Purchases grant a non-exclusive license for personal printing, social media sharing, and athletic recruitment. Commercial resale or advertising usage requires separate written authorization.


4. Access & Security Agreement

Gallery access is intended for Participants, families and authorized organizational staff only. I agree to keep login credentials, SMS codes, and direct links confidential. I further agree that images featuring other Participants (e.g., team composites) are for personal use only and will not be published to public forums, community groups, or large-scale social media audiences without the consent of those families.


5. Marketing & Portfolio Usage

  • Consent-Based: Usage for marketing, social media or portfolio display is governed by the specific selection made in the Digital Delivery Agreement for each unique event.
  • Identity Protection: Participant names are never included in public marketing or social media captions.
